Q5. Documents required for Court Marriage.

A.
    
Passport Size Photographs of Marrying Persons.
     Residential Proof of Marrying Persons.
     Date of Birth Proof of Marrying Persons.
     If any party is divorcee – Certified copy of Decree of Divorce granted by the Court.
     If any party is widow / widower – Death Certificate of the dead spouse.
     If any party is a Foreign Citizen or holding a foreign Passport or is having foreign residential address - Certificate of Present Marital Status of the party / No Impediment Certificate / NOC from concerned Embassy and Valid VISA.
     Residential Proof and PAN Card of Three Witnesses.



Q6. How much time / days the Court Marriage procedure takes for completion?

A.
The entire Court Marriage Procedure takes about 31 to 90 days for completion, as there is mandatory waiting period of 30 days between ‘notice of intended marriage’ and ‘performance and registration of marriage’.



Q8. Can I do it myself or I have to hire the services of Advocate / Lawyer / Attorney?

A.
Although Court Marriage on the face of it seems very simple process, we highly recommend the hiring of services of Advocate / Lawyer / Attorney conversant with Marriage and Family Laws.
     Various legal issues are involved regarding (i) the capacities of party to contract for marriage, (ii) the form of marriage which would be legal and valid, (iii) the appropriateness of the place of marriage and registration, (iv) the contents of Affidavits which have to be submitted to the Marriage Registrar, which your Advocate / Lawyer / Attorney can take care of.
     You can avoid unnecessary hassles and repeated traveling cost to the Marriage Registrar for getting into thick and thin of Court Marriage.
     Time taken in completing the process of Court Marriage various considerably depending upon, “how much conversant is the person with the process”.
     Various delays in the process of Court Marriage happens only because of the lack of knowledge of the process by the person handling the matter and for which Officials of Marriage Registrar are least responsible.
     Fees charged by the Advocate / Lawyer / Attorney are very small compared to the rise in cost because of inefficient handling of the case by inexperienced person.
     The most important aspect is - we receive a number of calls enquiring that the married couple wants amendment / rectification of mistakes in their marriage certificate as it contain errors, which you can avoid if the documentation is done by an experienced advocate, lawyer or attorney.
