Q1. How the cases received by the association would be assigned to its members? How a member of the association can assign its case to its other members? Is the association is going to differentiate in assigning its cases between a Senior Member of the Bar and a Fresh Member of the Bar? How the fee structure of any particular case is going to be determined?

A.
Kindly read the following example:

If a Client “C” based in Chennai contact a member of our association “X” based in Chennai for filing / prosecuting / defending a case at a Court of Mumbai.
The following steps would be taken for assigning the case:
     Step 1: Our member “X” has to take: -
            A brief details of the material facts of the case, and
            An approximate fee that the Client “C” is ready to incur in regards to the case.

     Step 2: Our member “X” would then send the said details to the our Association.

     Step 3: Our Association would then send the said details to all its members of Mumbai inviting them to propose: -
            The legal action to be taken in regards to the case, and
            The Fee of the Lawyer Member as well as the approx. expenses likely to be incurred in the case.

     Step 4: Once Our Association receives the details from its Mumbai Members, it would forward the said details along with the Bio-Data of the Mumbai Members to our member “X” at Chennai.
     Step 5: Client “C” in consultation with our member “X” would then have the discretion to choose any particular member of our association from Mumbai to whom he wants to assign his case.

     The aforesaid five steps would be taken by the association and its members for assigning any of their client’s cases to the other member of the association. By taking the aforesaid five steps: -

            Our Association would be eliminating all kinds of favoritism between a Senior Member of the Bar and a Fresh Member of the Bar; because the ultimate choice would be that of our Client “C” in consultation with our member “X”, who would assign his case to a particular member of our association as per his / her pocket, understanding of the case, and Seniority of the member of the Bar required for conducting his particular case,

            Our Association would also be giving discretion to our members of the Bar to quote Their Fee structure as per their Seniority in the Bar and Competency in the field, and

            Our Association may also be able to give discretion to our Client “C” in consultation with our member “X” to choose from many members of our association as per their Fee structure and Seniority.



Q2. Among the members and the association, whose responsibility it would be for the conduct of the case of the client?

A.
The responsibility for the conduct of the case of the client would be shared by the Member of the Association who has referred the case and the Member of the Association who is conducting the Case.

     Our Referrer Member would be responsible for:

            Client Dealing,

            Making available the status of the case to our client,

            All kind of communications required for the proper conduct of the case.

     Our member who is conducting the case would be responsible:

            For sincere conduct of the case.

            All kind of communications required for the proper conduct of the case.

     The whole idea behind the above-mentioned sharing of responsibilities is:

            Our client has to deal only with his local Lawyer,

            The local Lawyer would be dealing with the Lawyer conducting the case
