Q1. I want to let on rent as landlord a vacant flat (shop, property, house) belonging to me to person X as tenant, how to proceed?

A.
    
Hire the services of an Advocate for the drafting, preparation and registration, if any of the Rent Deed / Lease Deed.
    Provide your Advocate the following details for the drafting, preparation and registration, if any of the Rent Deed / Lease Deed: -
            The name, age, father’s name and residential address of landlord.
            The name, age, father’s name and residential address of tenant.
            The complete address of the flat (property, house, shop) along with the measurement of the area, the number of rooms, Kitchen, bathrooms, toilet, balcony, veranda etc., existing in the flat (property, house, shop) to be let on rent along with Site Plan, if any.
            The agreed rate of rent for the tenanted flat (property, house, shop).
            Whether the rent for the tenanted flat (property, house, shop) would be payable monthly or yearly, or after any other specified period by the tenant?
            The specific date of each English Calendar Month by which the rent has to be payable in advance by the tenant for the tenanted flat (property, house, shop).
            Whether any premium in the shape of pugre or security deposit is being called from the tenant for the tenanted flat (property, house, shop)?
            Whether the monthly / yearly rent for the tenanted flat (property, house, shop) would include or exclude the water bill or electricity bill or any maintenance charges payable to society?
            What is the period of tenancy? It can be for less than a year say eleven (11) months or for more than a year or for any other specified period.
            If the tenanted flat (property, house, shop) is being let on rent is for more than a year, whether there is any lock-in period for which period the tenant has to pay the rent even if he want to vacate the tenanted premises before the end of the period of tenancy?
            Whether the tenanted flat (property, house, shop) is to be used for Residential, Semi Residential or Commercial Purposes?
            Whether the Water Connection, Electricity Connection existing in the tenanted flat (property, house, shop) and House Tax / Property Tax / Municipal Tax being paid is for Residential or Commercial Use?
            If the tenanted flat (property, house, shop) is being let for commercial purposes, whose liability it would be whether of landlord or tenant for obtaining No Objection Certificate or approval or permission or any special permission from the appropriate authorities, say, National Capital Territories of Delhi/ Delhi Development Authority/ Municipal Corporation of Delhi or any other appropriate authority, if any required for the establishing its commercial activities at the tenanted flat (property, house, shop)?
            Whether you want to incorporate any clause regarding renewal of the tenancy on the determination of the tenancy by efflux of time?
            Who would pay the Stamp Duty, Registration Charges if any, and Advocate Fee for the Rend Deed / Lease Deed?
