Q1. What is “Domestic Violence”?

Domestic Violence means any act, omission or commission or conduct of family members causing Harms or injuries or endangering the health, safety, life, limb or well being, whether mental or physical, including physical abuse, sexual abuse, verbal and emotional abuse, economic abuse, or Harassment to coerce her or any person related to her to meet dowry demands, or Having the effect of threatening any woman in domestic relationship is defined as Domestic Violence.Q2. What are the claims that a Wife can make against her Husband and in-laws in “Domestic Violence” complaint?

In Domestic Violence, a Wife make allegations of domestic violence against husband, in-laws and his other relatives praying the Court that: In Resident Order, “Wife don’t have any residence of her own, and hence, a flat or room in the flat of husband should be exclusively provided to wife for residence and nobody should interfere; or, the husband should provide alternative accommodation to the wife”. In protection order, “Wife is being physically or mentally harassed by in-laws and husband and hence she should be provided separate residence by the husband and nobody should interfere in her life, and her life should be protected. In monetary relief, “Wife don’t have any means of livelihood, and hence, husband should pay monthly or other periodical sums for her expenses. In a compensation order, “Wife has suffered monitory loss in the shape of loss of her Salary Income, misappropriation of her money and dowry articles, medical bills etc., because of her husband and in-laws, and hence, her husband and in-laws should compensate her.Read further ...
